Residential Real Estate Transactions
If you are buying or selling a home in California, there are several legal requirements that you should be aware of. First and foremost, the seller must disclose any and all “material facts,” or property conditions, that may affect the potential buyer’s decision to purchase the home. Typically, the seller must complete a Transfer Disclosure Statement (TDS) form, which includes crucial information about the property, such as the condition of the roof, floors, insulation, foundation, etc.
Additionally, residential real estate transactions must go through a title company and title insurance company. Sellers are allowed under California law to negotiate with the buyer regarding who will pay for title insurance. Sellers must also use an escrow agent to finalize the sale of the home and may be required to pay a transfer tax.
